Brooks Act

The law requiring architect-engineer services to be selected on qualifications rather than price.

The Brooks Act (implemented in FAR Subpart 36.6) mandates qualifications-based selection for architect-engineer services. Agencies publicly announce requirements, evaluate firms on demonstrated competence via the SF-330, rank them, and negotiate a fair and reasonable price with the most qualified firm — turning to the next firm only if negotiation fails.
